Moving Back to India: The Order in Which Everything Has to Be Done
The 49-page playbook for Indian citizens and OCI cardholders coming home for good. The 182-day and 60 + 365 residency arithmetic, the RNOR window and what it really shields, the RFC account and the conversion order that keeps your currency and your exemption, property purchase and the 14% withheld on a sale, the Baggage Rules 2026 in full, and the first 90 days — every threshold verified against official sources in November 2026.

Two children, a container, a school admission and a house to rent. You need the order, not another article about India's growth story.
You have the job. You do not have a view on whether the return year will be taxed on your worldwide income, and the answer depends on a date.
You are flying back more often than you planned. The flat, the deposit, the tenant's TDS and the sale all need someone who knows the forms.
Nothing is booked yet. This is the best time to read it — the two decisions that cost the most are both made before the flight.
Six things that are hard to find in one place, verified for 2026-27
Section 6 of the Income-tax Act 2025, the 182-day and 60 + 365 tests, the arrival-date table for FY 2026-27, and three worked profiles that show how one week changes three years of tax.
Why the order matters — RFC first, then the NRE conversion — and how NRE interest loses its exemption on day one while RFC interest does not.
What an NRI may and may not buy, and the 14% withheld on a sale plus the Form 128 application that releases more than half of it.
The rules that replaced the 2016 version on 2 February 2026: Rs 7,50,000 for two years abroad, Rs 75,000 general allowance, one free laptop, and the three conditions people fail.
Aadhaar and PAN for citizens versus OCI cardholders, e-OCI, banking KYC, UPI, the credit-history cold start and insurance bought before you land.
Part 8, for readers who have already landed: the five most common mistakes, what is available, what it costs and how urgent it is.
10 parts, 70 sections — from the return decision to the appendix your CA will ask for
What changed in 2026, what this is not, and the four numbers that decide most of the money.
The honest audit, the two clocks (FEMA versus income tax), your day count, the arrival-date table, RNOR and what it shields, three worked profiles, and closing out the last tax year abroad.
The eight-account audit, the conversion sequence, RFC explained, retirement accounts left behind, DTAA and Form 67, Schedule FA and the Rs 10 lakh line, the "received in India" trap, LRS and TCS at 2% and 20%, and what becomes available once you are resident.
Buying, selling with the TDS surprise, Form 128, the 1 October 2026 TAN change, renting out, repatriation, a worked sale, and the annual cost of holding a flat.
The Baggage Rules 2026 line by line, transfer-of-residence eligibility and condonation, Annexure I versus II, ship-versus-rebuy arithmetic, the shipping plan, the customs folder, jewellery, and the five-sentence script at the counter.
Aadhaar and PAN, OCI and e-OCI, banking KYC and UPI, the credit-history cold start, driving licence, health insurance, and the proof of residence that unblocks everything.
The school calendar that should drive your arrival date, the elderly-parent care plan, the spouse's eighteen-month gap, the children's first ninety days, and a twelve-month family calendar.
Day-by-day checklists, the first-year tax calendar, twenty mistakes that cost the most, what the first year actually costs, and the questions buyers ask most.
The five retro-fixes with costs and urgency, FEMA compounding in outline, and the exact bundle to hand your chartered accountant.
Master checklist, day-count worksheet, arrival-date decision table, bank letter template, document request list, shipping inventory, twenty AI prompts, sources with verification dates, and a glossary.

Everything you need to know before buying
Probably not. From 2 October 2026 your stay falls below the 182-day test in section 6(2) of the Income-tax Act 2025, but if you spent 365 days or more in India across FY 2022-23 to FY 2025-26, the 60 + 365 test catches you at 60 days. The playbook includes a day-count worksheet and a full arrival-date table for FY 2026-27.
Rs 7,50,000, if you have been abroad for two years or more immediately before arrival, your short visits to India in the preceding two years do not exceed six months in total, and you have not claimed the concession in the preceding three years. The Rs 5 lakh figure comes from the Baggage Rules 2016, which were superseded with effect from 2 February 2026.
The FEMA direction requires NRE balances to be redesignated or moved to an RFC account when you become resident, which happens on the day you land to settle. There is no statutory grace period. The playbook gives the exact order to do it in — RFC first, then the resident savings account — because the order determines whether you keep the currency and the interest exemption.
On the entire sale consideration, not on the gain: 12.5% for a long-term gain plus surcharge capped at 15% for LTCG and 4% cess, which is up to about 14.95% effective. A lower deduction certificate in Form 128, applied for before the first payment, brings the deduction down to your actual gain.
Yes. Part 8 covers the five most common retro-fixes — an unconverted NRE account, a property sale without Form 128, a transfer-of-residence claim that falls short, a missing Form 67 and omitted foreign-asset disclosure — with what is available, what it costs and how urgent it is, plus an outline of FEMA compounding.
No. It is an information product that tells you what the rules say, which question to ask, and what the answer changes — and where the answer genuinely depends on your facts, it says so rather than inventing a number. Confirm your own position with a chartered accountant and, for property or FEMA matters, a practising lawyer.
